Terms of service
Version: 12 October 2026
1. Scope
These terms apply to every contract between one idea gmbh, Rothenburg, Switzerland ("we") and a business that uses GogoPlaner ("customer"). GogoPlaner is offered only to businesses, not to consumers. Other terms of the customer do not apply.
2. The service
GogoPlaner is software for running a bar: till, lady drinks and commissions, check-in, cash count, stock, schedule, expenses and reports. It runs in a web browser on Android tills and phones. We provide GogoPlaner as described on gogoplaner.com at the time of the order. We keep developing it and may change functions, as long as the core use (selling, payouts, closing the night, reports) remains.
We aim for high availability but cannot promise uninterrupted operation. Selling keeps working without internet; actions that need a personal code need internet. The customer provides suitable devices, printers and internet access.
3. Plans and prices
- Annual plan: ฿35,880 per bar for 12 months, paid in advance. It renews automatically for another 12 months unless it is cancelled before the end of the current term.
- Monthly plan: ฿4,490 per bar per month, paid in advance. It renews every month and can be cancelled at any time, effective at the end of the paid month.
Prices are in Thai baht. No Swiss VAT is charged (service to a business abroad). Taxes or duties in the customer's country, for example Thai VAT under the reverse-charge rules, are borne by the customer.
We may change prices for future terms. We announce changes at least 30 days in advance by email; the customer may cancel before the change takes effect.
4. Payment
Payment is by credit or debit card through Stripe, at the start of each term. If a payment fails, we inform the customer. After 7 days without payment the account becomes read-only: the customer can still close the night and export data, but cannot start new nights. We never stop a till during a running night.
Payments for terms that have started are not refunded, unless the law requires it or we fail to provide the service (section 8).
5. Duties of the customer
The customer confirms and makes sure that:
- it runs its business legally, holds all licences required in Thailand and complies with labour, tax, alcohol and entertainment laws;
- every person recorded in GogoPlaner is at least 18 years old and works voluntarily and legally;
- GogoPlaner is never used for forced labour, human trafficking or exploitation, or to hide income or evade taxes;
- it informs its staff about the processing of their data and has a legal basis for it (Annex A);
- it keeps personal codes and device access secret and removes lost or stolen devices immediately in "My bar";
- it remains responsible for its own bookkeeping, tax filings and any registration of point-of-sale systems with the Thai Revenue Department. GogoPlaner is not a registered tax POS and does not issue tax invoices.
If there are concrete signs of a breach of a), b) or c), we may block the account at once and end the contract without notice. Fees already paid are not refunded in that case.
6. Data of the customer
All data the customer enters belongs to the customer. We use it only to provide GogoPlaner. The customer can export its data at any time. The Data processing agreement in Annex A applies.
7. Support
Support by email in English, and in Thai where possible. We fix reproducible errors within a reasonable time.
8. Liability
Our total liability is limited to the fees the customer paid in the 12 months before the event that caused the damage. We are not liable for indirect or consequential damage, lost profit, data loss that the customer could have avoided by exporting its data, or losses from cash differences, theft, or misuse of codes or devices by staff. These limits do not apply to damage caused intentionally or by gross negligence.
9. Term and end of the contract
The contract runs for the chosen plan and renews as described in section 3. The customer cancels in "My bar" or by email to dave@oneidea.ch. After the end of the contract, the customer can export its data for 30 days. After 90 days we delete it, unless the law requires longer storage.
10. Changes to these terms
We may change these terms with at least 30 days' notice by email. If the customer does not agree, it may cancel before the change takes effect.
11. Applicable law and courts
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The courts at the registered office of one idea gmbh (Canton of Lucerne, Switzerland) have jurisdiction. We may also take action at the customer's seat.
12. Language
These terms exist in English and Thai. If the versions differ, the English version prevails.
Annex A — Data processing agreement
This annex applies when one idea gmbh ("processor") processes personal data on behalf of the customer ("controller") to provide GogoPlaner. It is based on the Thai Personal Data Protection Act B.E. 2562 (in particular section 40) and the Swiss Federal Act on Data Protection.
- Subject and duration: operation of GogoPlaner for the customer, for as long as the contract runs and until the data is deleted (no. 9).
- Data subjects and data: the customer's staff (ladies, waitresses, cashiers, managers, owners). Nicknames or names, numbers, roles, confirmation of the age check, working and break times, drinks, commissions, barfines and payouts linked to a person, schedules, personal codes (only as a hash), and the activity log (who did what, when, on which device).
- Instructions: we process the data only on the customer's instructions. The instructions are the functions of GogoPlaner that the customer uses, and any further instructions in writing. We tell the customer if we believe an instruction breaks data protection law.
- Confidentiality: everyone at one idea gmbh with access to the data is bound to confidentiality.
- Security: encrypted connections, data stored in Switzerland, personal codes only as a hash, devices paired one by one, automatic lock after repeated wrong codes, separation of each bar's data, backups, and access by our staff only where needed for operation or support.
- Sub-processors: the customer approves Supabase (database, Switzerland), Cloudflare (delivery and protection), Stripe (payments) and Resend (emails). We inform the customer at least 30 days before we add or replace a sub-processor. The customer may object and cancel. Sub-processors are bound by equivalent duties.
- Support: we help the customer, as far as reasonable, to answer requests from data subjects (access, correction, deletion) and with security incidents.
- Incidents: we inform the customer without undue delay, and at the latest within 48 hours after we become aware of a personal data breach affecting its data, so that the customer can meet its own duties (for example notification within 72 hours under the Thai PDPA).
- End: after the contract ends, the data can be exported for 30 days and is deleted after 90 days, including from backups within the normal backup cycle, unless the law requires longer storage.
- Proof: we provide the information the customer needs to show that this annex is followed.
- Transfers abroad: the data is stored in Switzerland. Transfers to other countries happen only as described in the Privacy policy (section 6), with appropriate safeguards.
